Copyright Clearance Services
If you want to use content created by others, you have a legal obligation to get clearance to use any copyrighted content. The copyright clearance process starts by identifying which content may be protected under US copyright law. If you don’t know which content requires clearance, ask us to make this determination for you. Go to our consulting page to start the conversation.
Copyrighted content may include text, photographs, song lyrics, graphs, illustrations, and other materials. Some content may be found to be in the public domain. On very rare occasions, some uses may be considered fair use, but this is a tricky proposition. Most content likely will be protected under copyright law and requires permission to legally use in your work. Over the past two decades we have cleared thousands of copyrights for clients across the United States.
Special collections at research libraries can have unique rights management issues. Click here to see a discussion of the range of services we provide to special collections.
Overview of Clearance Process
We can review the content you want to use and specify which items need to be cleared. We will identify the primary source of the content if you have not done so. Research will be conducted to find the copyright owner or administrator and request permission on your behalf. Once contact is made, we will clarify terms and conditions for the licenses, negotiate copyright license fees, and track the copyright clearance process.
The first step in our copyright process is to set up an initial one-hour consultation with our copyright specialists so that we can answer your questions about copyright issues and find out about the nature of your project. Click here to initiate a consultation.
The second step typically is to conduct an indepth review the new work for copyright issues. The review fee varies with the content, the complexity of outside works to be used, information known about the outside works, and other variables. We will provide a quote for the in-depth manuscript review after we have our initial consultation and conducted a cursory review of your manuscript.
After conducting the in-depth manuscript review, we provide an estimate of our fee. Our service fee will include: determining which materials are copyrighted and require permission, identifying the copyright owner(s), submitting formal requests for permission to use copyrighted materials, helping you negotiate owner’s license fees, reviewing terms and conditions of license agreements, and creating a tracking log to document the copyright clearance process.
The next step is up to you: simply contact us to set up an initial consultation about your project.
